Board of Adjustments

Overview

The Board of Adjustment (BOA) serves as a quasi-judicial body for the City of Granite Shoals, as authorized under the City's Zoning Ordinance (City Code Chapter 40). Its primary function is to hear and decide variance requests, allowing property owners to seek exceptions to the zoning regulations in cases involving special or unusual circumstances where strict enforcement would create undue hardship.

The Board consists of five to seven members and two alternate members, all appointed by the City Council. To ensure members are prepared for their responsibilities, each BOA appointee is required to complete an annual training course conducted by the City Attorney, focusing on the legal and procedural framework governing the Board’s authority. Members also receive instruction on Texas Open Meetings Act requirements to maintain transparency and compliance with state law.

The BOA does not meet on a regular schedule; instead, it convenes only when a variance application has been submitted, which can result in long intervals—sometimes months or even years—between meetings. When meetings are held, they are attended by the City Manager and City Attorney, who provide administrative and legal guidance. The City Secretary serves as the recording secretary, ensuring accurate documentation of all proceedings.

The Board’s role is critical in balancing the City’s zoning policies with the need for fairness and flexibility in land use decisions.
